These Terms of Use apply to your use of any website, mobile application or service owned or operated by Heka Health Inc. (registered under the French constitutive name Heka Santé Inc.), including the Paperminds websites, mobile applications and all related digital platforms, referred to collectively as the "Heka Platforms".

1. Access to the Platform

We grant you permission to access and use the Heka Platforms solely for your personal, non-commercial purposes, and only as permitted by these Terms of Use, for the purpose of accessing our services (the "Services").

Suspension or Termination

We may suspend your access to the Heka Platforms or terminate your account if your use breaches any of these Terms of Use. We may also withdraw, suspend or discontinue any functionality or feature of the application, the platform or the Services for any reason, including an unforeseeable or irresistible external cause.

Technical Interruptions

Where a technical or security threat affects the Heka Platforms, we may need to suspend the Services to keep them secure and operational. We will notify you of such a disruption as soon as we can. We are not liable for the interruption itself, and we will take reasonable steps to keep it short.

2. Links to Third-Party Sites and Third-Party Information

Some links on the Heka Platforms may direct you away to third-party websites. Those websites are not under our control, and we are not responsible for their content or for the links they contain.

Third-Party Use

Third-party links are included for your convenience and do not imply our endorsement. If you choose to visit a third-party website, you do so at your own risk, and we disclaim all responsibility for damage or loss resulting from reliance on that website.

Third-Party Content

Third-party content, data or publications made available through the Heka Platforms are provided as is, for your convenience. We make no warranty, express or implied, as to their accuracy or completeness.

3. Ownership of Intellectual Property Rights

The contents of the Heka Platforms, including all information, data other than user data, products, materials, services, software applications, tools, text, images, photographs, audio, video and graphic content, referred to collectively as the "Content", are the property of Heka Health Inc. or are used with permission.

Use of Intellectual Property

Unless expressly stated otherwise, use of any Content, trademark or intellectual property belonging to Heka Health Inc. is prohibited without our prior written consent. You may not transfer, sublicense or commercially exploit any part of the Content or of the Heka Platforms.

Nothing in these Terms of Use grants you any right or licence to use intellectual property owned by Heka Health Inc. or by a third party.

Linking Policy

You may not create a link to the Heka Platforms without our prior permission. Where permission is granted, it is a limited, non-exclusive right to link to the entry page of the platform, on the condition that the link does not portray us or our Services in a false or negative manner.

4. Privacy and Security

Heka Health Inc. collects and processes personal information in accordance with Quebec privacy law, in particular the Act respecting the protection of personal information in the private sector and the Act respecting access to documents held by public bodies and the protection of personal information, as amended by the 2021 modernization statute commonly called Law 25. We take measures to protect that information. Our Privacy Policy describes what we collect, where it goes, how long it is kept, and what you may ask of us.

5. Limitation of Liability

Heka Health Inc. provides the Services as is and will not be liable for damage resulting from the use of, or the inability to use, the Heka Platforms. The maximum liability of Heka Health Inc. is limited to the fees paid for the use of our Services, where applicable.

6. Governing Law

These Terms of Use, and any dispute arising from them, are governed by the laws of Quebec, and you agree to submit to the exclusive jurisdiction of the courts of Quebec.

7. Changes to the Terms and the Services

Heka Health Inc. may modify or discontinue any part of the Services or any feature without prior notice. Please review these Terms of Use from time to time so you are aware of any change. The revision date at the top of this document is updated whenever the text changes.
